My understanding is that the deadline for filing the appeal is before the next governor and AG take office. So while there may many reasons not to vote for Carly, this isn’t one of them.
The Federal Appeals Court is now deciding whether the Prop 8 backers have standing to carry on the appeal when the state’s Constitutional Officers want to drop it. The initial decision by the Appeals Court will come between the election and inauguration.
However, any request for a hearing by the full Appeals Court panel and other activity — such as a decision to appeal to the US Supreme Court — will drag into 2011 no matter which way the Appeals Court initially rules.
The new governor and attorney general will be making decisions on the appeals process.
